over the weekend this happend to me: came home sunday from rabbit hunting to be greeted by a police officer standing in my driveway. he asked for my i.d., i gave it to him. he said i was under arrest for failure to appear in court for a barking dog violation that was supposedly made months ago. i told him i had no idea what he was talking about. needless to say they handcuffed me and broght me to the police station. i had to post bond of 100.00 to get home. i asked when the original complaint was made and if there was a copy of the ticket for me to see. they could not produce anything! i was kinda pissed to say the least. what is this world coming to? anyone heard of such a thing?

Geeez!!! Don't the police and court system have anything better to do in Ohio than harrass people!!?? Thats ridiculous! I always thought that a sherriff had to come and give you a summons to appear in court. sheesh!

This is one occasion for a lawyer.
Were you ever served with a summons?

I don't know the details. But generally a summons like that would have been mailed not hand delivered. Secondly the police would not have a copy of it, they simply get the "warrant" from a judge and enforce it. Was it fair, right, wrong etc.... that's between you and the court.... the police just followed the court order issued to them with your name on it. Speaking as a police officer trust me, we never serve a warrant of any kind where people don't complain that we're wrong, and we're the bad guys. And 90% of the folks claim they have no idea what we're talking about. So while you most likely genuinely had no clue about this, understand the police hear that all the time and can't just leave people alone because they say that.

That said, the system makes mistakes as it has humans running it. I certainly encourage you to find out why you didn't get a copy of the original summons. Keep us posted and good luck.

i went to the courthouse at lunch today. the summons was supposedly sent to me by mail. BUT, its supposed to be certified mail or hand delivered by said court. none of the details of conformation of the delivery of the summons were documented. locating a lawyer today and i'll make sure this never happens to me again. lastly, to the officer that responded, i understand you have heard it all. i dont contest the fact of the dogs barking and would have went to court and paid my fine as i've did in the past. however, right, wrong or indifferant you shouldn't be able to arrest anyone on the - he said she said- rule of " we mailed it to you". without my knowledge, this is a crime against me!!! and to cuff me and take me from my home for dogs barking is bull$hit.

I'm definetly not saying you're wrong. Sounds like you may have gotten a raw deal here and hope it works out for you. I'm just pointing out, your're getting arrested was the court order.... not the police just going off he said she said. Folks are always wanting to say I can't believe the police did this or that.... like folks were saying in this thread, "don't the Sherriff have more important things to do". Yes they do, they don't like messing with this stuff either.... thats why I was just pointing out warrants and summons are court ordered, the police just obey whats sent to them. Again, hope it works out and keep us posted. Sorry this happened to you.

The US Constitution guarantees FAIR PROCESS this has Gone to the wayside over the years We are becomming more and more a POLICE state.
You are also guaranteed a trial by your PEERS on Any Court case If More people were to stand up and Demand thier rights Less of this Would happen We need to Flood the Courts with all this SMALL TRIVIAL stuff as some call it until We can Get our RIGHTS back... I would definatley get a lawyer...
But then again i DEMAND a hearing For every Ticket I get even if its JWALKING
We as a PEOPLE ARE INNOCENT until PROVEN Guilty
Make em Prove it!!!!!!!!

Most of Your police Officers are Decent honest Folks just trying to make a living and a DIFFERENCE its THIER superiors that Get cought up in the political BS that cause a lot of the Problems....
Dont get me Wrong i have the upmost respect For most officers until they prove me otherwise......

i deal with the same thing where i live.animal control has been to my house a number of times but she just checks the kennels for food, water, shelter, and cleanliness and leaves.i live in a hollow that is still city limits.we have an ordinance.luckiley the A.C. OFFICER is a nice lady and a dog lover,or i would be in the same boat.as for the police officer doin his job, sure that is what he was doin, what agrivates me is here is a man just housing dogs and they rush out and arrest him, well my house was robbed recently and my father and i went to the neighbors, got their story, tracked down a payphone that the thieves called from, obtained survalence footage of the people, car ect.,found out where some of the stuff was sold.we have all the evedince neededto arrest the people and the police won't do a thing.but let a dog bark and they jump and arrest a man.go figure.they don't worry about getting the theives in our town, they want to arrest the people that buy the stuff ,not knowing it was stolen, and arrest them for recieving stolen property.why, cause the thieves don't have money for fines the people that buy the stuff do.that way the city gets paid.
